Terms of Service

These Terms of Service (the "Terms") govern your use of the mobile games Cake Home and ManaWorld (the "Games") and the website operated by Beijing Xinhaihai Technology Co., Ltd. ("PHX Studio", "we", "us", or "our"). By downloading, installing, accessing, or playing our Games, you agree to be bound by these Terms. If you do not agree, do not use the Games.

1. License to Use the Games

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and play the Games on devices you own or control, solely for your own non-commercial entertainment, subject to these Terms and the rules of the app store from which you obtained the Game.

2. Accounts

Some features may require an in-game account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and notify us promptly of any unauthorized use. You may not sell, transfer, or share your account.

3. Virtual Items and In-App Purchases

• The Games may offer virtual currency, items, or other content ("Virtual Items") for purchase with real money or earnable through gameplay.
• Virtual Items have no real-world monetary value, are not redeemable for cash, and may not be transferred outside the Game.
• All purchases are processed by the Apple App Store or Google Play and are subject to their payment terms. Except where required by law, all sales are final and non-refundable.
• We may modify, manage, or discontinue Virtual Items at any time, with or without notice, to the extent permitted by law.

4. Acceptable Use

You agree that you will not:

• Use cheats, exploits, bots, automation software, or unauthorized third-party tools;
• Reverse engineer, decompile, or attempt to extract the source code of the Games, except as permitted by law;
• Interfere with or disrupt the Games, servers, or networks;
• Harass, threaten, or abuse other players, or post unlawful, offensive, or infringing content;
• Engage in fraud, including fraudulent purchases or chargebacks;
• Use the Games for any commercial purpose without our written consent;
• Violate any applicable law or regulation.

We may suspend or terminate accounts that violate these rules, with or without notice.

5. Intellectual Property

The Games, including all artwork, characters, storylines, music, code, and trademarks, are owned by or licensed to Beijing Xinhaihai Technology Co., Ltd. and are protected by intellectual property laws. These Terms do not grant you any ownership rights. Any feedback or suggestions you provide may be used by us without obligation or compensation.

6. Updates and Availability

We may update, patch, or modify the Games at any time, and some updates may be required to continue playing. We do not guarantee that the Games will be available at all times or on all devices. We may suspend or discontinue a Game or any feature, in which case your sole remedy is set out in Section 7.

7. Disclaimer of Warranties

THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHX STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE GAMES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS (US$50) IF YOU HAVE MADE NO PAYMENTS.

9. Age Requirements

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Games. If you are under the age of majority, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

10. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Beijing Xinhaihai Technology Co., Ltd. is established, without regard to conflict-of-law principles. Any dispute will first be attempted to be resolved informally — contact us at support@phxgame.com — before formal proceedings are initiated. Nothing in these Terms limits any mandatory consumer rights you have under local law.

11. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date above reflects the latest version. Continued use of the Games after changes take effect constitutes acceptance of the revised Terms.
